General Terms of Sale — PixiLearn Training Courses

Article 1 – Registration

You may register online on the PixiLearn platform, by email at contact@pixilearn.fr or by post at the following address: Pixilib, 2 rue Léonce Castelbou, 31000 Toulouse.

Your registration will be taken into account upon receipt of the duly signed professional training agreement or contract and these General Terms of Sale.

For distance learning courses, it is the participant’s responsibility to ensure that their computer equipment is properly configured before the course, within the time allowed, and to comply with the general terms of use (GTU) available on the PixiLearn platform.

Article 2 – Cancellation – Replacement

To be taken into account, any cancellation must be notified in writing. Participants may be replaced at any time, free of charge, provided that PIXILIB is informed in writing and sent the names and contact details of the replacement(s) no later than the day before the course.

You may cancel a registration free of charge provided that you inform PIXILIB by registered letter with acknowledgement of receipt or by email with acknowledgement of receipt to contact@pixilearn.fr, received no later than 14 calendar days before the date of the course.

If a cancellation is received less than 14 calendar days before the date of the course (or of the first module for a programme or a distance learning course), the full registration fee remains payable to PIXILIB.

Any course which the participant did not attend, or attended only partially, is payable in full.

Article 3 – Prices – Payment

All prices are stated exclusive of tax. They will be increased by the duties and taxes in force.

Our prices include the training via the PixiLearn educational platform, the educational documentation provided during the course and, where applicable, the electronic files made available. For any questions regarding our prices, please contact our customer service by email at contact@pixilearn.fr.

If payment is made by a third-party organisation, that organisation’s funding agreement must reach us before the first day of the course. If PIXILIB has not received the funding agreement, you will be invoiced for the full cost of the course. In the event of partial funding by a third-party organisation, the portion not covered will be invoiced directly to you.

Any invoice not paid by its due date will automatically bear interest at three times the interest rate applied by the European Central Bank to its most recent refinancing operation. If a single invoice is not paid by its due date, all sums owed by the Client will become immediately payable.

Any invoice recovered by our debt collection department will be increased, as a non-reducible penalty clause within the meaning of Article 1231-5 of the French Civil Code, by a fixed indemnity of 15% of the amount due.

Article 4 – Liability – Indemnities

The employer or, as the case may be, the participant undertakes to take out and maintain, in anticipation of and for the duration of the course, civil liability insurance covering bodily injury, property damage, consequential and non-consequential loss, both direct and indirect, likely to be caused by their actions or those of their employees to the detriment of PIXILIB or of the participants.

They also undertake to take out and maintain civil liability insurance for any acts harmful to third parties caused by their employee, containing a waiver of recourse clause, so that no claim can be brought against PIXILIB.

Article 5 – Right of control

PIXILIB reserves the right, if the number of participants in a course is considered insufficient from an educational point of view, to cancel the course no later than 14 calendar days before the scheduled date.

PIXILIB reserves the right to postpone the course, change its location, modify the content of its programme or replace a trainer if circumstances beyond its control so require.

PIXILIB reserves the right to cancel a registration before the course begins in the event of non-compliance with the registration rules or a manifestly erroneous registration (for example: prerequisites not met, supporting documents not provided); in this case the participant is notified and not invoiced.

PIXILIB reserves the right, without any compensation whatsoever:

• To refuse any registration or access to a Client whose payments are not up to date.
• To exclude any participant who has made false declarations when registering.

Article 6 – Intellectual property

In order to respect the intellectual property rights attached to the course materials, software and other educational resources (including imaging clinical cases) made available solely to the course participants, the Client shall not, directly or indirectly, in whole or in part, reproduce, adapt, modify, translate, represent, market or distribute said materials and educational resources to members of its staff who are not participants in PIXILIB courses or to third parties without the express, prior and written authorisation of PIXILIB or its successors in title.

Article 7 – Data protection

PIXILIB undertakes to ensure that the collection and processing of your personal data comply with amended French Law No. 78-17 of 6 January 1978 on information technology, data files and civil liberties (the “Loi Informatique et Libertés”) and with Regulation (EU) 2016/679 of 27 April 2016, known as the “General Data Protection Regulation” (or “GDPR”).

This policy describes how PIXILIB undertakes to collect, use and protect your personal data. In accordance with Articles 39, 40, 41 and 42 of amended Law 78-17 of 6 January 1978, you may exercise your rights of access, rectification and objection by contacting PIXILIB’s DPO.

Article 8 – Governing law – Jurisdiction

This agreement is governed by French law. In the event of a dispute over the interpretation or performance of any of these provisions, and failing an amicable agreement between the parties, the commercial court with jurisdiction over the registered office of the training organisation shall have sole jurisdiction.
